Michael Jackson videotape case loses judge

Los Angeles County Superior Court Judge Soussan Brugera has removed herself from the retrial of a lawsuit against a charter jet company that secretly videotaped Michael Jackson. The judge stated she wanted to avoid any appearance of impropriety.

In 2008, Brugera awarded $20 million to two attorneys who claimed the now-defunct company Xtrajet and its owner, Jeffrey Borer, violated their privacy during a 2003 flight where they and Jackson were videotaped. Jackson was flying from Las Vegas to California to face child molestation charges where he was later acquitted.

The judgment was overturned on appeal but one lawyer sought a retrial rather than accept a much smaller award. Trial is set for Feb. 14.

Jackson himself had withdrawn his name from the suit years before.
